Draft bill for the new version of the Technical Instructions on Air Quality Control (TA Luft) of 16th July 2018

On 26th July 2018 the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety published the draft bill for the new version of First General Administrative Regulation to the Federal Immission Control Act (Technical Instructions on Air Quality Control) including an explanatory statement.

By this means, immission control in Germany is to be amended and adapted to European legislation. As a central set of rules for air pollutant emission and immission control, TA Luft specifies the state-of-the-art for more than 50,000 plants subject to licensing in Germany.

In many fields, the state-of-the-art has developed since 2002. The Federal Ministry for the Environment, Nature Conservation and Nuclear Safety has now presented a new draft bill as of 16th July 2018. With this amendment of TA Luft a consistent and legally certain administrative regulation has been developed with the aim of simplifying its implementation.

In the process, several regulations from European legislation are transposed into national law. This applies in particular to decisions of the European Union on BAT conclusions on the basis of the Industrial Emissions Directive and the included requirements for precaution. The state-of-the-art is checked for all plants with regard to particularly relevant air pollutants like nitrogen oxide and particulate matters.

Besides, compared to TA Luft 2002 the amended TA Luft is to include requirements on odour immissions and process control requirements to preserve the natural habitats of flora and fauna (FFH directive) and to take into account nitrogen deposition and bioaerosol immissions.
