Effects of the amendment of the BBodSchV as of 1st August 2023 on assessment values for immission measurements and forecasts

In July 2021, the so-called “Mantelverordnung” (Ordinance on the Introduction of a Substitute Building Materials Ordinance, on the Revision of the Federal Soil Protection and Contaminated Sites Ordinance and on the Amendment of the Landfill Ordinance and the Commercial Waste Ordinance) was adopted.

According to Article 5, paragraph 1, sentence 2 of the Ordinance of 9th July 2021 (BGBl. I p. 2598), the BBodSchV will be repealed as of 1st August 2023 and replaced by a new version. With the revised version of the Federal Soil Protection and Contaminated Sites Ordinance (BBodSchV) the regulation, which has remained almost unchanged since 1999, is adapted to the current state of scientific knowledge and the experience gained in its enforcement.

With the new version a number of requirements and criteria are changed, including the permissible additional annual loads of pollutants across all input pathways. Especially for chromium and copper deposition this results in significantly lower assessment values, which can have a relevant influence on the assessment in current approval procedures.

With regard to planned permits and changes to existing permits, these new target values should be taken into account in forecasts and EIA reports.
